1. Introductory Provisions
1.1. These Terms and Conditions (hereinafter referred to as the “T&C”) govern the rights and obligations between the seller and the buyer arising in connection with the conclusion of purchase contracts through the online store available at fuji.pictures.

1.3. The buyer is a consumer or a business entity. A consumer is defined as a natural person who, when concluding a contract, does not act within the scope of their business activity (§ 419 of Act No. 89/2012 Coll., Civil Code).
1.4. These T&C are prepared in accordance with the applicable legal regulations of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and consumer protection regulations.
2. Information About Goods
2.1. The seller offers, through the e-shop, mainly original photographs, custom-printed photographs, and finished photographic products.
2.2. The offered products may be:
- custom-made according to the buyer’s requirements, or
- ready-made products without individual modifications.
2.3. The price and characteristics of the goods are always stated for each specific product in the e-shop.
3. Conclusion of the Purchase Contract
3.1. The presentation of goods on the e-shop is for informational purposes only and does not constitute an offer to conclude a contract.
3.2. The purchase contract is concluded when the buyer submits an order and the seller confirms its acceptance by email.
3.3. By submitting an order, the buyer confirms that they have read and agree to these T&C.
4. Price and Payment Terms
4.1. All prices are stated in Czech crowns (CZK).
4.2. The seller is not a VAT payer.
4.3. The payment method is specified on the e-shop website.
4.4. Goods are dispatched after the full purchase price has been credited to the seller’s account, unless stated otherwise.
Incorrect Pricing and Non-Conclusion of the Contract
- Correction of pricing errors. If the price of goods or services listed on the seller’s website or during the ordering process is clearly incorrect (e.g. significantly lower than the standard selling price of that type of goods or services), the seller is entitled to correct such an error and not conclude the purchase contract at the incorrect price.
- No entitlement to delivery. In such a case, the customer is not entitled to delivery of the goods at the incorrect price. The seller is not obliged to deliver the goods or fulfill any obligations arising from such an order.
- Customer notification. The seller will inform the customer without undue delay about the pricing error and the non-conclusion of the contract using the contact details provided in the order. If the customer has already paid the incorrect price, the paid amount will be refunded without undue delay.
- Definition of an obvious error. An obvious pricing error is a price that deviates from the usual market price to such an extent that it is clearly a mistake even to an average consumer (e.g. significantly below purchase price or common competitor pricing).
5. Delivery Terms
5.1. Goods are delivered to the address specified by the buyer in the order.
5.2. The delivery time varies depending on the nature of the goods, particularly whether they are custom-made or ready-made products.
5.3. The buyer is obliged to inspect the goods upon receipt.
6. Withdrawal from the Contract
6.1. A consumer has the right to withdraw from a distance contract within 14 days of receiving the goods without stating any reason (§ 1829 of the Civil Code).
6.2. Withdrawal must be made by a clear statement delivered to the seller.
6.3. The consumer is obliged to return the goods within 14 days from withdrawal.
7. Exceptions to the Right of Withdrawal
7.1. The consumer does not have the right to withdraw from the contract pursuant to § 1837(d) of the Civil Code if the subject of the contract is goods made according to the consumer’s requirements or tailored to their personal needs.
7.2. This includes in particular:
- custom-printed photographs,
- photographs produced based on the buyer’s individual selection (motif, format, paper, frame),
- products manufactured only after the buyer places an order.
7.3. For these products, withdrawal within the 14-day period without stating a reason is not possible.
8. Complaints and Rights from Defective Performance
8.1. The rights and obligations of the contracting parties regarding defective performance are governed by the relevant provisions of the Civil Code.
8.2. Exceptions to the right of withdrawal do not apply to claims regarding defective goods.
8.3. The buyer may submit a complaint by email or in writing to the seller’s contact address.
9. Personal Data Protection
9.1. The seller processes the buyer’s personal data in accordance with applicable legal regulations.
9.2. Detailed information is provided in a separate document titled “Privacy Policy”.
10. Out-of-Court Dispute Resolution
10.1. The Czech Trade Inspection Authority (Česká obchodní inspekce) (www.coi.cz) is responsible for out-of-court resolution of consumer disputes.
10.2. Consumers may also use the online dispute resolution platform available at ec.europa.eu/consumers/odr.
11. Final Provisions
11.1. These Terms and Conditions are valid and effective from the date of their publication on the e-shop website.
11.2. The seller reserves the right to amend these T&C.
